Accelerate the deployment and take-up of the INSPIRE Directive data infrastructure

Potential of action

The main objective of the INSPIRE Directive, establishing an Infrastructure for Spatial Information in Europe, is to improve the sharing of spatial information for environmental policies and policies and activities having an impact on the environment among public sector organisations and across borders. In addition, INSPIRE supports the re-use of spatial public sector information by third parties as it requires to facilitate the public access to spatial information across Europe. Its implementation increases efficiency and effectiveness for public administrations and for the private sector. Companies looking for spatial and environmental data can save some 15% in time and money, which is worth some EUR 150 million per year [1]. For SMEs, in particular, it can contribute to reducing time and cost of product or service delivery, can generate new customer groups or geographic markets and can lead to new or significantly improved methods, products or services[2].

Description of action

The European Commission has made a substantial evaluation [2] [3] of the INSPIRE Directive (2007/2/EC) which was carried out in the context of its Regulatory Fitness (REFIT) programme, one of the priorities of the Commission under the Better Regulation agenda. The main results of this substantial assessment and the proposed follow up actions have been published in a Commission Report [4].

This evaluation has demonstrated that the INSPIRE Directive is still largely fit-for-purpose, but that further efforts are needed at EU and Member State level to close remaining implementation gaps and to harvest the benefits of the Directive.

Member States have agreed on a ‘Maintenance and Implementation Work Programme 2016-2020[5]. The following key actions below are to close the identified gaps in implementation and to adapt the legal framework for maximising the benefits from the INSPIRE Directive in the light of emerging policy requirements:

  • Fostering “Fitness for purpose” of the legal framework and guidance
  • Priority setting for spatial data and services for end user applications
  • Further alignment with national, EU and international policies/initiatives
  • A continued support to implementation

The (quantified and qualified) progress made by the Member States vis-à-vis the follow-up actions identified in the REFIT is documented in country fiches [6] and a comparative EU overview fiche [7].

To further level the playing field and guide the implementation towards a comparable offering across Member States, the Commission has selected monitoring and reporting under the environmental acquis as a priority use case for the development of a first set of pan-European information products. Based on the evaluation of reporting obligations under the environmental legislation, a preliminary list of priority datasets [8] related to environmental reporting obligations was prepared by the Commission in collaboration with the Member States. The number of environmental priority datasets in the INSPIRE catalogue made accessible by Member States is slowly but gradually increasing [9].

A reengineered version of the INSPIRE Geoportal [10], that was released in September 2018, provides an online dashboard that allows for assessing the actual state of implementation in the Member States and EFTA countries.

As part of the fitness for purpose review of the legal framework, a new Implementing Decision on INSPIRE reporting (C(2019)6026) [11] was adopted end of August 2019 and an amendment of Commission Regulation No 1089/2010 on interoperability of spatial data sets and services is currently under preparation. Adoption of the legislation is indicatively scheduled for summer 2020. This will conclude the actions and recommendations in the MIWP 2016-2020 to address the implementation gaps identified in the REFIT exercise.

In addition to the above, there is scope to look further into the coherence and possible synergies of the INSPIRE Directive with other EU legislation and, in particular promoting its application in the wider Digital Single Market agenda and the “eGovernment” (including open data) processes. One particular legislation that offers clear opportunities for streamlining is the Open Data and re-use of PSI Directive that was adopted in June 2019, where streamlining can be envisaged regarding re-use and data sharing provisions and the definition of High-Value Datasets in a dedicated Implementing Act planned for adoption in 2021.

All actions and recommendations have been implemented through the Maintenance and Implementation Work Programme 2016-2020. Further actions to align the INSPIRE Directive with other initiatives and maximise its relevance in view of the twin digital and green transition will follow from the evaluation of the Directive due by 1 January 2022.
